§ 1 Scope of application
For the business relationship between Moosbaum GmbH (hereinafter Moosbaum) as the operator of the Internet portal "ScienceStore - LifeSciences Calendars and more" (lifesciences-calendar. com) and the customer, the following General Terms and Conditions in their valid version at the time of ordering apply exclusively. Moosbaum does not recognise any deviating terms and conditions of the customer, unless Moosbaum has expressly agreed to their validity in writing.
§ 2 Conclusion of a contract
When you place an order with lifesciences-calendar. com, we will send you a pro forma invoice by e-mail, which will confirm the receipt of your order and list its details. Your order constitutes an offer to us to conclude a purchase contract. We accept this offer if we inform you by e-mail that we have shipped the goods or (in case of "Advance bank transfer") your payment has been credited to one of our bank accounts in accordance with the pro forma invoice. No purchase contract is concluded for products from the same order that are not listed in the pro forma invoice.
§ 3 Revocation
Cancellation policy
The customer can revoke his declaration of contract within 2 weeks without giving reasons in written form (e. g. letter, fax, email) or - if the goods are handed over to you before the deadline - by returning the goods. Moosbaum does not reimburse shipping costs. It is pointed out that Moosbaum may withhold a reduction in value caused by putting the item into use. Early bookers who order at special conditions are expressly excluded from the right of withdrawal. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in case of recurring delivery of similar goods not before receipt of the first partial delivery) and also not before fulfilment of our information duties in accordance with Art. 246 § 2 in conjunction with Section 1 (1) and (2) of the German Civil Code as well as our obligations pursuant to Section 312 e (1) sentence 1 of the German Civil Code (BGB) in conjunction with Section 312 e (1) sentence 1 of the German Civil Code (BGB). Art. 246 § 3 EGBGB. The punctual dispatch of the revocation or the goods suffices to comply with the revocation period.

§ 4 Shipment
Unless otherwise agreed, delivery shall be made ex warehouse to the delivery address indicated by the customer. Information about the delivery period is non-binding, unless the delivery date has been confirmed in a separate e-mail with the subject "delivery date confirmation".
§ 5 Due date and payment, delay
Depending on the status of the orderer, an individual payment term applies, which is indicated to him during the ordering process. Private customers can choose to pay by bank transfer or cash on delivery. For corporate customers, public institutions and institutions, a payment term of 10 days after delivery (receipt of goods) applies. Moosbaum reserves the right to assign different terms of payment for individual customers.
If the customer defaults on payment, Moosbaum shall be entitled to charge interest on arrears in the amount of 5% above the base interest rate p. a. announced by the European Central Bank. to demand. If Moosbaum can be proven to have incurred higher damages caused by delay, Moosbaum is entitled to assert this.
§ 6 Special features when purchasing on payment terms
In the case of purchases with a payment term of more than 7 days, Moosbaum checks and evaluates the customer's data and, if justified, maintains an exchange of data with Creditreform Berlin Wolfram KG, Einemstrasse 1,10787 Berlin.
§ 7 Set-off, retention
The customer shall only be entitled to a right of set-off if his counterclaims have been legally established or acknowledged by Moosbaum. In addition, he shall only be entitled to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.
§ 8 Retention of title
The delivered goods remain the property of Moosbaum until full payment has been made.
§ 9 Liability for defects
If there is a defect in the object of sale, the customer can demand subsequent performance (remedy of defects or replacement delivery). If the supplementary performance fails, the customer can withdraw from the contract, reduce the purchase price or claim damages in the case of a not inconsiderable defect.
Unless otherwise stated below, further claims of the customer - irrespective of the legal grounds - are excluded. Moosbaum is therefore not liable for damage that has not occurred to the delivery item itself; in particular, Moosbaum is not liable for loss of profit or for other financial losses on the part of the customer. Insofar as Moosbaum's liability is excluded or limited, this shall also apply to the personal liability of employees, representatives and vicarious agents.
The above limitation of liability does not apply if the cause of damage is based on intent or gross negligence or if personal injury exists. Furthermore, it does not apply if the customer asserts claims under §§ 1,4 of the German Product Liability Act (Produkthaftungsgesetz).
.If Moosbaum negligently violates a material contractual obligation, the obligation to pay compensation for damage to property is limited to the typically occurring damage.
The statute of limitations is twenty-four months, calculated from delivery.
§ 10 Protection of privacy
Information on the type, scope, location and purpose of the collection, processing and use by Moosbaum of the personal data required for the execution of orders, registration for the e-mail notification service can be found in Privacy Policy.
§ 11 Applicable law
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
